TERMS AND CONDITIONS FOR FIXIT

The Terms and Conditions contained below outlines the basic rules and regulations for the Use of MYFIXITAPP for users and Artisans.

By clicking on accept, we assume that you have accepted these Terms and Conditions. Do not continue if you do not agree to take all the terms and conditions stated here.

 

  1. TERMS AND CONDITIONS FOR USE 

In this section “1” the word “app” refers to MYFIXITAPP.

You acknowledge and agree that:

If you choose to contract with any of our artisan without using the services provided for in the app, we will not be responsible for any outcome resulting from such contractual relationship,

To have an individual/artisan come into your home to carry out any form of repair or for any job to be done, you will have to fill in your Bank Verification Number details which will serve as a security measure,

Our repair warranty is for two months on any replacement part,

All queries should be made via the platform for quick and easy response,

Warranty does not cover physical damages, in cases of warranty claims information regarding device should be sent via any of these means: video recording, pictures which should be sent to MYFIXITAPP for response and processing

Ensure that products are properly tested before receiving it.

Complaints should be logged in within the first seven days after job deliver

We reserve and hold the exclusive the right to suspend or restrict access to our app, for example, we may suspend access to the app during maintenance or when the app is being updated. You must not at any time either before, during or after such, bypass or circumvent, or attempt to bypass or circumvent, any access restriction measures on the app.

 

  1. DURATION 

Where items of any kind are left in our custody/ artisan for a period exceeding the period of Two Months it will no longer be our official responsibility.

Where items of any kind are left in our custody for a period of more above Two Months then it will be at an extra cost, which will be fixed by us.

 

  1. TERMS AND CONDITIONS FOR ARTISANS

Artisans will have a remuneration of Thirty percent from every job,

Where there is any damage of any kind, the artisan will be responsible/liable for such damage and will bear the cost of indemnifying,

Parts used for Jobs done by the artisans are to be only original parts

Where there is a case of theft/stealing whether directly or indirectly, such act will lead to a dismissal,

Work gears must be worn by all artisans during contacts with clients,

Payments will be made to artisans after seven days of work delivery,

The full/detailed bank information of artisans are needed for proper documentation.

Artisans must have guarantors for proper identification,

Where we have a reasonable belief or it is discovered that there is any misinformation in the personal details or otherwise of artisans, then such act will lead to a dismissal,

Artisans are not allowed to personally deal with clients without prior notification or instruction,

Artisans will be responsible for proper and adequate care of devices in their custody

While job cost will be determined by artisan, the prices for all work done, must be reasonable and will be compared with the current market value/prices,

  1. LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with the laws of the territory.

Any dispute in relation to services and the usage of our app/ the terms and conditions stated herein shall be subject to the exclusive jurisdiction of the courts of the territory.

  1. SEVERABILITY

If any provision of these terms and conditions is determined by a competent court of law for being unlawful and/or unenforceable, the other provisions of these terms and conditions will continue to be effective.

If any of part of the provisions in these terms and conditions will be lawful and enforceable when a part is deleted, then that part is deemed deleted, and the rest of the provisions of these terms and conditions will be in effect.

  1. VARIATION

These general terms and conditions, the User and Artisan terms and conditions contained herein can be reviewed from time to time by us.

The reviewed terms and conditions shall apply from the date of publication on the MYFIXITAPP

  1. ENTIRE AGREEMENT

These terms and agreement with respect to the user and artisan terms and conditions which are stated shall constitute the entire agreement between you and us in relation to your use of MYFIXITAPP and shall override any other agreement.

  1. BREACH OF ANY OF THE SECTIONS IN THESE TERMS AND CONDITIONS

If you breach/ contravene any of the sections in these terms and conditions, or where we have any reason to reasonably suspect/believe that you have already breached the terms and conditions herein stated, we may:

Temporarily suspend, prohibit or block your access on MYFIXITAPP,

Permanently suspend, prohibit or block you from accessing MYFIXITAPP,

Contact any or all service providers and request that they block your access to MYFIXITAPP

Block computers/mobile devices using your IP address from accessing MYFIXITAPP

Commence legal action against you for breach of contract, or any other.

Whereby we temporarily/permanently suspend, prohibit, and/or block your access on MYFIXITAPP, you must not take any action whether directly/indirectly to circumvent such suspension, prohibition, blocking by creating a different account.

  1. ASSIGNMENT

You may not without our prior written consent assign or otherwise deal with any of your rights and/or obligations under these terms or obligations.

  1. THIRD PARTY RIGHTS

All these terms and conditions expressly stated herein is for the benefit of our users and smooth management of MYFIXITAPP,

The exercise of these terms and conditions, and also rights are not subject to the approval or consent of any third party.

  1. PAYMENTS

All payments must be made in accordance with the payment information and guideline provided on MYFIXITAPP.
